If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Description of service

Quicky Cocktails Mobile Services Ltd is a platform that connects customers with service businesses in Mauritius, enabling live queue management, bookings, and home service requests. We provide tools for businesses to manage walk-ins and appointments, and for customers to discover, book, and queue for services.

3. Account and credentials

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information when creating your account and to keep this information up to date. You must notify us immediately of any unauthorised use of your account.

4. Acceptable use

You agree not to misuse the Service. Prohibited activities include, but are not limited to:

• Using the Service for any unlawful purpose or in violation of any applicable law.
• Engaging in fraud, spam, or deceptive practices.
• Infringing upon the intellectual property rights of others.
• Interfering with or disrupting the security, integrity, or performance of the Service, including through malware, hacking, probing, or scraping.
• Reverse engineering, decompiling, or attempting to extract the source code of the Service.
• Reselling, redistributing, or sublicensing access to the Service without our prior written consent.
• Circumventing any technical limits or usage restrictions of the Service.

5. Intellectual property

Quicky Cocktails Mobile Services Ltd retains all ownership rights to the Service, including all software, documentation, branding, logos, and content provided by us. These Terms do not grant you any licence or right to use our trademarks or branding without our prior written consent. You are granted a limited, non-exclusive, non-transferable right to use the Service within the scope of your selected plan.

6. User content

You retain ownership of any content you submit to the Service (such as reviews, profile information, or business listings). By submitting content, you grant Quicky Cocktails Mobile Services Ltd a limited licence to host, process, and display that content solely for the purpose of providing the Service.

7. Payment, subscriptions, and Paddle Merchant of Record

Certain features of the Service require payment of fees. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Subscriptions automatically renew unless cancelled before the renewal date. You are responsible for all applicable fees and taxes. We reserve the right to change our pricing with reasonable notice.

8. Service level

We strive to keep the Service available and functioning correctly, but we do not guarantee uninterrupted or error-free performance. The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Limitation of liability

To the fullest extent permitted by law, Quicky Cocktails Mobile Services Ltd's aggregate liability shall be limited to the total amount paid by you for the Service in the 12 months preceding the claim. We shall not be liable for any indirect, consequential, special, or punitive damages, including loss of profits, data, or goodwill, arising out of or relating to these Terms or the Service, except where liability cannot be excluded by law (such as for fraud, death, or personal injury).

10. Indemnity

You agree to indemnify and hold harmless Quicky Cocktails Mobile Services Ltd and its affiliates from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

11. Suspension and termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for reasons including but not limited to: material breach of these Terms, non-payment of fees, security or fraud risk, or repeated or serious policy violations. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will continue to apply.

12. Governing law and disputes

These Terms shall be governed by and construed in accordance with the laws of Mauritius. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Mauritius.

13. Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets without restriction.

14. Force majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, strikes, or internet service provider failures.

15. Changes to terms

We may modify these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.
